Terms of Trade and Refund Policy:
Acceptance
Logan Info Tech Services (also referred as ‘LITS’) is a registered business name for the sole trader business, Mr Jonathan David Leete. Your request for IT Services and IT Goods is conditional on acceptance to the Terms and Conditions, policies, safety guidelines, notices and disclaimers set out when requesting Logan Info Tech Services’ IT Services and the IT Goods provided to undertake such a service and in the provision of IT Goods. By proceeding to obtain Logan Info Tech Services’ IT Services and IT Goods constitutes to you agreeing to Logan Info Tech Services’ Terms and Conditions. Logan Info Tech Services reserves the right to amend the Terms and Conditions at any time and without notice to you. By continuing to use Logan Info Tech Services’ IT Services and IT Goods after any amendment is made to the Terms and Conditions and is made effective constitutes you to agreeing to the amended Terms and Conditions.
Capacity
Logan Info Tech Services’ IT Services and IT Products are only available to individuals and/or businesses who can be bound by a legally binding contract. Logan Info Tech Services’ IT Services and IT Goods are not available to individuals and/or businesses prohibited from entering into legally binding contracts. By requesting Logan Info Tech Services’ IT Services and IT Goods, therefore accepting Logan Info Tech Services’ Terms and Conditions, you acknowledge you are legally able to enter into binding contracts and are eighteen years or over.
Strict Compliance
As part of the Terms and Conditions, customers have the responsibility for the use of the IT Services provided and IT Goods provided by Logan Info Tech Services. Logan Info Tech Services shall not be held liable for any loss or injury incurred by the use of Logan Info Tech Services IT Services and/or IT Goods purchased.
Prices / Quotes
Quotes are priced in AUD (Australian Dollars) and are valid for thirty days starting from the day the Quote was issued before work (LITS’ IT Services) begins and/or goods are supplied (LITS’ IT Goods). The Quote states the estimated amount of work to be charged (IT Services) along with the cost of computer equipment and/or software (IT Goods) provided to fulfill the service. Quotes can be subjected to change if the customer wishes to extend or diminish the tasks and scope of the work to be completed. If the customer supplies incorrect information in the issuing of a Logan Info Tech Services Quote the Quote becomes invalid and a new Quote needs to be issued with the amendments and corrections in place. Tax invoices will be supplied display the prices of the IT Goods and IT Services in the event LITS is registered for GST, and the prices quoted don’t include Goods and Services Tax.
Purchasing of Goods and Services
Logan Info Tech Services reserves the right to accept and refuse any order for IT Services and IT Goods, and an acknowledgement of an request order does not mean that Logan Info Tech Services has accepted the order. Logan Info Tech Services reserves the right to commit to any estimated date range when IT Services and IT Goods will be estimated to begin and be estimated to be delivered, and by the customer accepting the Quote they agree to this estimated date range where Logan Info Tech Services IT Services and Goods will be estimated to be delivered. Acceptance of the customer’s offer (by agreeing to a Quote) will only occur upon email verification (titled “Quote Verification”) confirming the Quote was accepted.
Service and Goods Delivery Policy
Logan Info Tech Services can provide IT Services and IT Goods both on-site and off-site. Logan Info Tech Services will need to be granted access to the customer’s premises and IT systems if the IT Goods or IT Services being provided requires it, and the customer agrees to this when accepting a Quote. The customer also agrees that Logan Info Tech Services has the right to complete work at its office if applicable. Logan Info Tech Services, in the event that IT Goods (computer equipment and software) need to be sent to a site, products will be shipped by Australia Post, and estimate to take up to ten days to arrive at the destination, however LITS does not guarantee to deliver on this time frame, and only uses this as a guideline.
Customer Demographic
Logan Info Tech Services has only the capacity to provide IT Goods and IT Services to Australia-Based customers. Logan Info Tech Services IT Services can only be delivered in South-East Queensland.
Handling of IT Goods
Logan Info Tech Services reserves the right to ship IT Goods once the Quote has been accepted, for up to three months after the Quote is accepted, depending on availability of the IT Goods from LITS’ suppliers. In the event that it takes more than ten days to ship IT Goods, the customer will be notified and asked if they wish to proceed with the Quote and/or if other IT Goods can be sourced to fulfill the same purpose.
Lost in Transit
If IT Goods sent by Logan Info Tech Services are lost in transit, an investigation is to be completed by Australia Post before the IT Goods are to be replaced.
Title, Insurance and Risk
Logan Info Tech Services is not responsible for any losses, damages and/or liabilities if the IT Services and IT Goods are delivered later than expected, and/or Logan Info Tech Services is unable to fulfill IT Services or the supplying of IT Goods and the order/quote is cancelled. Logan Info Tech Services shall have ownership of all the IT Services, IT Goods and Intellectual Property provided to the customer until payment of the work done and goods received (as quoted in invoices) is paid in full. Intellectual Property may remain with Logan Info Tech Services after payment of the invoice if it is in the terms of the agreement and acceptance of a Quote, given LITS’ flexible IP arrangement to reduce costs to the customer.
IT Goods Refund Policy
IT Goods provided and purchased through Logan IT Services must be refunded within thirty days of purchase, as defined by the Consumer Rights Act, in the event the IT Goods are faulty, not as described or unfit for the purpose. IT Goods provided by Logan IT Services that have been used, installed or been put into operation that breach the Terms and Conditions and/or have been tampered with, and/or used outside of the normal operating norms as defined by the manufacturer, are not subject to a refund or exchange.
Service Cancellation Policy
IT Services provided by Logan Info Tech Services should fulfill the rights of the customer as defined by Australian Consumer Law. The customer receiving IT Services from Logan Info Tech Services can cancel the IT Service in the event that the IT Service is not fit for the purpose intended, the service is not fulfilled in a reasonable time if there is no agreed end date and that it was provided with undue care and skill. Refunds on IT Services provided by Logan Info Tech Services can be made using the same method of payment originally used to pay for the IT Service, in the event Australian Consumer Law requires a refund be made. Cancellations of the IT Service can’t be made if the consumer wants an IT Service provided in a particular way against Logan Info Tech Services’ advice, did not supply adequate detail the needs to Logan IT Services or the consumer has changed their mind.
